What Is an Overage?
When a home is foreclosed upon and sold, the debt or (tax or mortgage) obligations that generated this chain of events is paid off. Then, the remainder of the funds from the home’s sale is called an overage to which the homeowner is legally entitled.
Why Didn't the Court Notify Me About This?
There is a time limit on which the homeowner can apply to receive their overage. If they do not initiate legal action in a timely manner to obtain it, the property escheats to the government. In other words, they get to keep it, not you. This is why they NEVER inform the homeowner of overages.
How Can You Help Me?
CRP handles all aspects of the recovery of your cash, from research such as locating the trustees or judicial representatives who are holding your money, to hiring the necessary attorneys, to filing documents with the court, to obtain your money back for you that is left over after the sale of your home. All you need to do is sign a few papers, sit back, and wait for your check.
Can't I Just Do This Myself?
Yes, technically, any person is allowed to self-represent; however, this is a fairly technical and complex process and area of law that our experts have received specialized training to navigate on your behalf.
What's In It for CRP?
The homeowner receives the majority of the money, and we fund our continued efforts to help homeowners by receiving a portion of the money we recover for them. You see, we outlay all the work and legal fees in advance. We receive no compensation at all until and unless we recover money for you that you otherwise would not receive.
Where Are You Located?
Much of our work is done virtually, by computer, in the courthouse, etc. We do, however, have a brick-and-mortar office in downtown Eugene, Oregon if you prefer to sign papers in person.
How Do I Know Your Company Is Legit?
Connie Marsh, our Oregon Director, is a lifelong Oregon resident who holds a master’s from Vermont Law School. She freelances as a paralegal, and has gone through a foreclosure training program targeted to help you preserve your rights and obtain your rightful cash. You can find CRP registered on the Oregon Secretary of State’s website.
How Long Does It Take Before I'm Paid?
Courts move slowly. The process can take several weeks. A few cases can even take months to complete. However, if you knew you were expecting a bona fide check for five- or six-figures that you could cash, would you not be willing to wait? After all, the time is going to go by anyway.
